Terms of Service

1. Agreement

These Terms of Service (“Terms”) are an agreement between you and FKV LLC (“QikFinds”, “we”, “us”) and cover your use of the QikFinds website at qikfinds-extension.com, your QikFinds account and the QikFinds Chrome extension (together, the “Service”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you use QikFinds for a business, you agree on behalf of that business.

2. The Service

QikFinds helps Amazon sellers research products: on supported retail stores it shows matching Amazon products with information such as price, sales rank, fees, eligibility, hazardous-material flags and estimated profit. The stores supported, the features in each plan and the Service itself may change over time.

QikFinds is a research tool. The information it shows comes from Amazon, Keepa, retailers and our own calculations, and may be incomplete, delayed or wrong. You are responsible for your own buying and selling decisions, for checking information before you act on it, and for following Amazon's rules and the law.

3. Your account

• You must be at least 18 and give accurate information when you sign up.
• Keep your password safe. You are responsible for everything done through your account, including by sub-users you add.
• Each plan includes a set number of users. Sharing one login among more people than your plan allows is not permitted.
• Tell us straight away at quincy@qiklists.com if you think someone else has used your account.

4. Amazon and Keepa connections

Some plans need you to connect your Amazon seller account and add your own Keepa key. You must have the right to use those accounts, and your use of them stays subject to Amazon's and Keepa's own terms and fees. QikFinds is not run by, or endorsed by, Amazon or Keepa, and we are not responsible for their services being available or accurate.

5. Plans, trials and payment

• Paid plans are billed in advance, monthly or yearly, through Stripe, at the price shown when you sign up.
• Free trials. We may offer a free trial on some plans from time to time, and we may change its length or stop offering it at any time. When a free trial is available, here is what to know: the length and plan are shown when you sign up; a trial is for new customers, one per person or business; you may be asked for a card to start it; and unless you cancel before the trial ends, your card is charged when it ends and then at the start of each billing period.
• Plans renew automatically until you cancel. Prices may change; we will tell you in advance, and a new price applies from your next billing period.
• If a payment fails, we may pause or limit your account until it is paid.
• Prices do not include any taxes that may apply.

6. Cancelling and refunds

You can cancel at any time from your account or by emailing quincy@qiklists.com. Your plan stays active until the end of the period you have paid for and then stops; it does not renew. We do not give refunds for partly used billing periods, except where the law requires.

7. Acceptable use

You agree not to:

• copy, resell, share or give others access to the Service or its data, except sub-users your plan allows;
• take apart, copy or try to get around the Service, its limits or its security;
• use the Service to break the law, Amazon's policies or any retailer's terms;
• use automated tools to pull large amounts of data from the Service, or overload it.

We may suspend or close accounts that break these rules.

8. Our content

QikFinds, its extension, website, designs and logos belong to us or our licensors. We give you a personal, non-transferable right to use the Service while your account is active and you follow these Terms. Amazon, Keepa and retailer names and logos belong to their owners.

9. Changes and availability

We work to keep QikFinds running but cannot promise it will always be available or error-free; stores may change their pages, and outside services may stop working. We may update the Service and these Terms. If we change the Terms in an important way, we will tell you by email or in QikFinds before the change takes effect. Continuing to use the Service after that means you accept the new Terms.

10. Ending your account

You can stop using QikFinds and close your account at any time. We may suspend or close your account if you break these Terms, do not pay, or if we stop offering the Service; if we stop the Service entirely, we will refund any prepaid time you have not used.

11. Disclaimers

The Service is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will meet your needs, that its information is accurate, or that using it will make you money.

12. Limit of liability

To the extent the law allows, QikFinds is not liable for any indirect or consequential losses, or for lost profits, sales, data or business, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

13. Governing law

These Terms are governed by the laws of the State of California and the United States, and any dispute will be handled in the state or federal courts located in California, unless the law where you live says otherwise.
